General Contractors and Sub-contractors - Hurricane Ike’s Second Set of Victims
When we think of the victims of Hurricane Ike, we tend to think of property owners, including homeowners and business owners in and around the Houston and Galveston area. However, there has been a second-wave of victims in the aftermath and rebuilding of Hurricane Ike. Unlike the property owners, the second-wave of victims, General Contractors and Sub-contractors, do not have insurance to subsidize their loss when clients refused payments when the job has been complete. The result is not only crippling the contractor’s income, but also threatening their livelihood and their ability to take on additional jobs.
At Veritas Legal Group, P.C., we are experience litigators who assist many contractors to obtain secured payments through several ways. First, our Houston Insurance Claims Attorneys and our Galveston Hurricane Ike Insurance Lawyers will work with the general contractors to properly file claims. Our Houston Hurricane Ike Claims Attorneys will review each insurance contract and demand payments for covered damages, including but not exclusive to Replacement Cost Value (RCV) or Actual Cash Value (ACV), additional living expenses (ALE), and for content loss. If necessary, our attorneys will also file suit on behalf of the clients and obtain proper payments.
Second, our Houston Construction Contract Lawyers and our Galveston Mechanic’s Lien Lawyers will work with homeowners and contractors to act as an escrow to insure proper payments for general contactors and other craftsmen. This process will allow insurance payments to flow through our law office and insure all contractors are paid properly and timely prior to the final disbursement to the property owners. As such, contractors can concentrate on what they do best instead of trying to collect on dead-beat clients who received insurance proceeds but refuse payments for services rendered.
Third, if you have non-paying clients, our Galveston Breach of Construction Contract Lawyers and our Houston Mechanic’s Lien (Materialmen’s Lien) Attorneys will draft demand letters, lien notice letters, and affidavits to file mechanic’s liens. The liens will encumber the property and the owners may not sell such property until the lien is satisfied. Further, our Houston Construction Litigation Attorneys and our Galveston Construction Law Suit Lawyers will file suit to recover damages caused by clients’ non-payments, including consequential damages to your business.
Lastly, our Houston Contract Drafting Attorneys and our Galveston Construction Contract Lawyers will review your current contract and make appropriate revisions to protect you from frivolous suits. Additionally, our Houston Construction Contract Compliance Lawyers and our Galveston Residential Construction Liability Attorneys will assist you in registering your company, d.b.a., or business with the Texas Residential Construction Comission, as well as registering each residential project that exceeds $10,000 in services. Please contact our experienced lawyers at Veritas Legal Group, P.C. to set up a personal consultation.
